It is the goal of the Oakland University Police Department to provide professional police services to everyone who visits or lives within the university community.  To help make your stay with us as enjoyable as possible and to avoid problems with the police, we would like to take a moment and emphasize the prevailing laws pertaining to alcohol on campus:

 

M.I.P. (Minor in Possession of Alcohol, in part)

436.1703 Purchase, consumption, or possession of alcoholic liquor by minor; attempt; violation; fines; sanctions; furnishing fraudulent identification to minor; screening and assessment; chemical breath analysis; notice to parent, custodian, or guardian; construction of section; exceptions; "any bodily alcohol content" defined.

Sec. 703.

(1) A minor shall not purchase or attempt to purchase alcoholic liquor, consume or attempt to consume alcoholic liquor, possess or attempt to possess alcoholic liquor, or have any bodily alcohol content, except as provided in this section. A minor who violates this subsection is guilty of a misdemeanor punishable by the following fines and sanctions and is not subject to the penalties prescribed in section 909

Drunk Driving (Operating While Impaired, in part)

257.625 Operating motor vehicle while intoxicated; operating motor vehicle when visibly impaired; penalties for causing death or serious impairment of a body function; operation of motor vehicle by person less than 21 years of age; requirements; controlled substances; costs; enhanced sentence; guilty plea or nolo contendere; establishment of prior conviction; special verdict; public record; burden of proving religious service or ceremony; ignition interlock device; “prior conviction” defined.

Sec. 625.

(1) A person, whether licensed or not, shall not operate a vehicle upon a highway or other place open to the general public or generally accessible to motor vehicles, including an area designated for the parking of vehicles, within this state if the person is operating while intoxicated. As used in this section, "operating while intoxicated" means either of the following applies:

(a) The person is under the influence of alcoholic liquor, a controlled substance, or a combination of alcoholic liquor and a controlled substance.

(b) The person has an alcohol content of 0.08 grams or more per 100 milliliters of blood, per 210 liters of breath, or per 67 milliliters of urine, or, beginning October 1, 2013, the person has an alcohol content of 0.10 grams or more per 100 milliliters of blood, per 210 liters of breath, or per 67 milliliters of urine.

Possession of alcohol  Oakland University Ordinance # 5.01

The following provisions govern the general possession and consumption of alcoholic beverages on the campus:

A person who is less than 21 years of age shall not possess or consume any alcoholic beverage on the campus.

A person shall not provide any alcoholic beverage to a person less than 21 years of age on the campus.

No person shall consume or possess any alcoholic beverage on the campus except in permitte areas as established by this section.  The lawful possession and lawful and moderate use of alcoholic beverages shall be permitted:

In private areas of university housing facilities including rooms, suites and apartments.

In private homes on campus.

During scheduled and official university activities on campus as approved by the President.

The use of alcoholic beverages shall not be deemed to be moderate if it causes material impairment of the senses, judgment or physical abilities of the user or if it causes the user to create a disturbance that interferes with the normal and uninterrupted use of the campus.

It shall be a misdemeanor for a person to be intoxicated on the campus and acting in such a manner that endangers directly the safety of another person or of property or causes a disturbance that interferes with the normal and uninterrupted use of the campus.
